Since the bancarotta<\/em><\/span>, in medieval Italy, until the Concurso\nMercantil of our era, from time to time it becomes necessary\nface the same problem: for different reasons a merchant\nbecomes unable to pay his\/her\/its debts, and creditors are\nforced to recover, in the best of cases, a portion of the resources\nbeing owed, be it through the entering into an agreement or\nthrough selling assets that are still available.<\/p>

In essence, when a commercial entity (called a merchant under\napplicable law) is adjudicated in concurso mercantil the initial\nobjective, at least during the conciliation stage, is to try to reach\nan agreement with creditors, and turn around the company, but if\nsuch agreement is not reached the objective becomes totally\ndifferent. By such time it is considered that the company has no\nfuture, and there is no other avenue to follow but to sell assets\nand distribute among creditors the proceedings so obtained,\ncomplying with applicable law.<\/p>
